FINEXUS International Sdn Bhd [Company Reg. No. 200901000571/0843494-U)] (“FISB”) values its customers'(“User”) rights with respect to their privacy and personal information in accordance with all relevant laws, including the Personal Data Protection Act 2010 (“PDPA”)
This Privacy Policy (“Policy”) outlines the practices for collecting, handling, and processing Personal Information given by our customers. This Policy shall be enforced alongside the Terms and Conditions (“Terms”) of the FIDU website/ mobile app (“Portal”).
By registering and/or using the Portal, you are deemed to have agreed to the collection, use and disclosure of your Personal Information in accordance with this Policy. FISB reserves the right to change the contents and/or services offered on the Portal including this Policy at any time without notice. You are advised to periodically review this Privacy Policy for changes.
This Policy must be read together with the Terms of the FIDU Portal. In the event of any inconsistency of between this Policy and the Terms, the Terms shall prevail.
The Personal Information and/or Personal Data shall include any information about you or something to identify you including but not limited to your full name, date of birth, gender, nationality, postal and email address, mobile number, identification details, sensitive personal data as defined under the PDPA and other information relevant to FISB (collectively referred to as “Personal Information”).
Third Party Information (“Third Party”) are sources that are not linked or associated to your Personal Information. Third Party cannot be used to identify individuals.
We may collect, record, process, use, hold, disclose and store any Personal Information including but not limited to:
- Information you provide to us through your use of the services under FIDU including but not limited to:
- Personal information from you including your first and last name, profile picture, gender, age, phone number, current address, email address, device ID number and passwords;
- Information you consented whilst using the services under FIDU;
- Information such as invoices, documents and other details as required by the regulators from time to time.
- Information from Third Parties which you have given your consent to disclose relevant information relating to you including but not limited to our affiliates, subsidiaries, employees, consultant, industry related associates, law enforcement agencies, government agencies or authorities;
- Information from other sources; and/or
- Information collected from you about others.
The information collected by FISB will vary based on your utilisation of the services and the features that are available on the FIDU Portal.
To access the features of the FIDU service, the user is required to register. During this process, you are required to register a username and password for the user account. This information is also known as your personal identification details which will be stored until you choose to close your account.
For the purpose of Know Your Customer (KYC) verification, we may request that you to promptly provide us with additional information regarding the information you have submitted to us while using our services. You are responsible for ensuring that the Information you provide to us is accurate, complete, and not misleading and that such Information is kept up to date. If you have reasons to believe that your records with us are inaccurate, incomplete, or not updated, you may make such corrections via the FIDU platform.
We may use your Personal Information in one or more of the following circumstances or for one or more of the following purposes (collectively referred to as “Purposes”) and you hereby consent to the processing by FISB of your Personal Information in accordance with the Purposes set forth below:
- To provide you with products and/or services that you have registered/applied with us;
- To facilitate your registration and/or application for the products and services under FIDU;
- To determine the eligibility of your application;
- To enable the sharing, transfer, retrieval, updating and processing of your Personal Information and data as well as creation of member profile and/or user accounts to enable you to receive the services related to FIDU and between our related affiliates, subsidiaries, respective group companies, parent company, associates to provide you with the products and services in relation thereto;
- To enable the sharing, transfer, retrieval, updating and/ or processing of Personal Information with FISB service providers, licensees, contractors, advisors, consultants, merchants and/or strategic partners to provide you the products and services in relation thereto;
- To enable the processing of your personal Information to administer and enable the continuous operation of your account created under FIDU.
- To provide you with information on any application and submission made within the Portal;
- To process your e-invoices application and for the operational and administrative purposes, including without limitation, sending you notifications, and managing your account;
- For communication and ensuring customer satisfaction, which may include conducting surveys to improve the quality of our Services, responding to inquiries and complaints and to resolve disputes (if any) or to enforce our terms and conditions, including the terms and conditions relating to our Services;
- Maintaining your application and submission history for present and future references;
- For legal documentation relating to a product and/or service provided;
- For such other purposes as set out in any other terms and conditions (if applicable) and campaign terms and conditions (if applicable); and
- For any purpose made known to you at the time of collection of your Personal Information.
FISB may use general, aggregated information to generate statistics and measure site activity to improve the usefulness of customer visits. Such information does not include Personal Information.
We may disclose your Personal Information to:
- Our related corporations, affiliates, subsidiaries, associates, service providers, licensees, advisors, merchants, strategic partners, third party contractors whether located within or outside Malaysia for the Purposes, subject to applicable laws or compliance requirements such as the Foreign Account Tax Compliance Act (FATCA);
- Governmental agencies, regulatory authorities (including Bank Negara Malaysia and Lembaga Hasil Dalam Negeri Malaysia), statutory authorities, law enforcement agencies, whether located within or outside Malaysia for the Purposes;
- Any credit reporting agency, credit bureau, and/or financial institutions, subject to regulatory and/or statutory requirements.
Your Personal Information may also be disclosed to other third parties with whom we have commercial relationships, for marketing, advertising and related purposes, unless you have indicated that you do not wish for FISB to disclose to such third parties for marketing and advertising purposes, and as required or authorised under the applicable law or provided in co-operation with any governmental authority.
FISB may hold your information in either electronic or physical form for a period of seven (7) years pursuant to the PDPA, or for such period as required by other applicable laws. We may also engage third parties to hold that information on our behalf and we will ensure to procure such third parties to incorporate our security standards as a minimum. All Personal Information will be destroyed or de-identified when no longer needed.
FISB shall take all reasonable measures to ensure the security of your Personal Information by implementing security measures based on industry standard practices. All Personal Information collected through the Portal shall be stored securely to protect against any misuse and/or unauthorised access.
You are responsible for maintaining the secrecy of your Login ID and password for the Portal. Do not share your password and other sensitive information with anyone. FISB personnel are not authorized to ask you for your Password.
As a valued user, you have the following rights regarding your personal data under this privacy policy:
- Right to Access: You have the right to request and review your personal data FISB processes about you;
- Right of Rectification: You have the right to rectify any of your personal data that FISB has processed if you find it to be incorrect;
- Right to Complain: You have the right to lodge a complaint against the processing of your personal data by FISB or against direct marketing activities.
- Right to Forgotten: You have the right to submit a request for the removal of any of your personal data that FISB has processed;
If you wish to exercise any of the abovementioned rights, please submit your request via e-mail. FISB reserves the right to conduct a verification process prior to responding. FISB aims to respond to all requests within 30 days. However, if a request is complex or pertains to a specific right, the response time may be extended. Any such extensions will be communicated to you accordingly.
The FIDU Portal may contain links to websites or applications operated by third parties (“Third-Party Applications or Websites”). Clicking on a link or taking any action as requested to connect to any other Third-Party Applications or Websites, will redirect you away from the Portal, and you may be required to provide your Personal Information. FISB has no control over and is not responsible for the privacy practices or the content of those Third-Party Applications or Websites. This Policy does not apply nor extend to those Third-Party Applications or Websites regarding their content or any collection that occurs after you connect to them. FISB is not responsible for any risks or loss or damages from the use of Third-Party Applications or Websites. FISB advises you to read the privacy practices of those linked sites.
The FIDU Portal may use cookies or similar technologies to enhance your browsing experience. Cookies are packages of data that are placed on your device by websites that you visit. They are widely used to make websites work more efficiently and to provide information to the owners of the site. Cookies may be disabled or removed by adjusting the settings in your browser.
